- Takeoutwizard.com (the company) provides an easy to use searchable restaurant database. It is not directly affiliated with any of the restaurants listed on the website and therefore is not responsible for the products or services provided by those restaurants.
- The company has provided a recent listing of menu items and prices. The prices and menu items are the ultimate responsibility of the restaurant and therefore can be different than those listed on takeoutwizard.com.
- The company provides a means to search for the latest restaurants and menu items. It does not guarantee the service or food products provided by restaurants.
- The company states that all orders placed online may or may not require a confirmation phone call from the restaurant to clarify credit card information if applicable, delivery address and/or order items.
- The company tries to maintain an accuracy rate of 95% on delivery areas for restaurants. If a restaurant does not deliver to certain areas of the stated postal code, your order will be put in cancelled status and you should see receive an email and phone call saying your order will not be filled for delivery.
- The company will provide fast order entry and subsequent relay to the requested restaurant. The subsequent meal preparation and delivery of the food is the responsibility of the restaurant.
- The user agrees to not hold the company responsible for any illness or financial loss incurred as a result of the consumption of the food prepared by the restaurant.
- The user agrees to not hold the company liable for any unfilled order as a result of incorrect order entry or mishandling by the associated restaurant.

In no event shall the company, its affiliates, franchisees, business partners, and suppliers, and their respective officers, directors, employees and partners be liable for any direct, indirect, consequential, special or exemplary damages, lost revenues or profits, or any other damages whatsoever arising from or in connection with the use or inability to use, or the performance of this web site or any of its contents or links, even if we have been previously advised of the possibility of such damages.

| Internet Transmissions not Secure |
You acknowledge and agree that the transmission of data and other communication over the internet is not secure, and that your transmission may be lost, intercepted, altered or redirected while in transit. You agree that the company is not responsible for these or any other problems (including any resulting losses) you experience from using the company’s web site or links, or sending and/or receiving e-mail with us.

These Terms of Use shall be governed by, and construed in accordance with, the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of laws provisions thereof. You hereby: (i) consent to the exclusive jurisdiction of the courts of, and venue and situs in, Toronto, Ontario for any litigation arising out of or relating to your use of the company’s web site, (ii) waive any objection to the venue of any such litigation in the Ontario courts, and (iii) agree not to plead or claim in any litigation brought in Toronto, Ontario has been brought in an inconvenient forum.
If any provision of these Terms of Use is held invalid or unenforceable in any respect by any court having competent jurisdiction, such provision shall be enforced to the maximum extent permitted by law, and the remaining provisions of these Terms of Use shall continue in full force and effect.
No waiver of any provision of these Terms of Use shall be deemed a further or continuing waiver of such provision or any other provision of these Terms of Use.
